    Permanent Residence in Poland

     

    GENERAL INFORMATION

    A non-Polish citizen may be granted permission to reside in Poland for a specified period of time (temporary residence) or a permission to settle (permanent residence).

    RESIDENCE PERMIT FOR A SPECIFIED PERIOD

    Permission for temporary residence may be granted, if the non-Polish citizen demonstrates that his/her residence on the territory of the Republic of Poland for a period longer than 3 months is justified, because of work, conducting of economic activity, studies, a marriage to a Polish citizen, etc. 

    The permission for temporary residence may be granted for a period necessary for realization of purpose of the non-Polish citizen's stay in Poland, no longer than for to 2 years.

    An application should be submitted to the appropriate consulate of the Republic of Poland. Non-Polish citizen already in Poland may apply directly to the appropriate regional office of a provincial governor.

     FORMAL REQUIREMENTS

    A non-Polish citizen who intends to apply for temporary residence in Poland should submit:

    • four application forms (wniosek o udzielenie zezwolenia na zamieszkanie na czas oznaczony i wydanie karty czasowego pobytu) filled out in Polish
    • five passport size photographs ( 4.5 cm -3.5 cm )
    • documents identifying the source of income or evidence of financial resources appropriate to support the stay in Poland
    • consular fee
    • a valid passport

    In addition, the Consulate may request the following documents:

    • a birth certificate
    • a marriage certificate
    • a certificate showing that the applicant has no outstanding financial obligations in the country of origin
    • a certificate issued by the appropriate authority of the country of origin, showing that the applicant has no criminal record

    A non-Polish citizen applying for temporary residence based on employment in Poland should also submit:

    • a valid work promise certificate issued by the appropriate local executive authorities or other document proving that such a permit is not required
    • documents of medical insurance or documents certifying that the cost of medical care on the territory of the Republic of Poland are covered by the insurer
    • legal title to an apartment.

    A non-Polish citizen applying for temporary residence based on conduct of economic activity in Poland through a company incorporated under Polish law, where he/she is an owner/shareholder should also submit:

    • current excerpt from the court's commercial register (the proof of incorporation)
    • a copy of a notaries deed establishing the company
    • a certificate from the appropriate Polish revenue office demonstrating no outstanding taxes or tax liens
    • an original valid work promise certificate issued by appropriate local executive authorities or other document proving that such a permit is not required, if the applicant takes employment
    • documents of medical insurance or documents  certifying  that the cost  of medical care, on the territory  of the Republic of Poland are covered by the insurer
    • legal title to an apartment

    A non-Polish citizen applying for temporary residence based on studies in Poland should submit additionally:

    • an original certificate confirming enrollment with the school or university in Poland and describing (curriculum based) expected time of graduation
    • document certifying a stable and regular source of income, sufficient to cover the cost of maintenance of the non-Polish citizen and depending members of his/her family
    • documents of health insurance
    • legal title to the apartment and documents certifying the cost of residence

    Spousez of Polish citizens shall submit additionally certified copy of marriage certificate and copy of the husband's/wife's Polish passport.

    PERMIT TO SETTLE ON THE TERRITORYOF THE REPUBLIC OF POLAND

    A permit to settle can be obtain exclusively by a non-Polish citizen who meets the following requirements:

    • is a minor child of a non-Polish citizen who holds a permit to settle, born on the territory of the Republic of Poland,
    • has been married to a Polish citizen for minimum 3 years before making an application and immediately before making an application had been residing on the territory of the Republic of Poland uninterruptedly for at least 2 years on the basis of residence permit issued for a specified period,
    • immediately before making an application had been residing on the territory of Poland for a period not shorter than 10 years on the basis of a permit for a tolerated residence, or for 5 years in connection with a refugee status,
    • is a child of a Polish citizen and is under parental authority.

    Residence on the territory of Poland is deemed uninterrupted if it was not broken for longer than 6 month and all the breaks together did not exceed 10 months, unless the break was caused by:

    • fulfillment of professionals duties and work outside the territory of the Republic of Poland, on the basis of an agreement made with an employer whose place of business is situated on the territory of the Republic of Poland,
    • accompanying a spouse who fulfils his professional duties of works as defined above,
    • a need to obtain a new travel document,
    • medical treatment of an alien.

    FORMAL REQUIREMENTS

    A non-Polish citizen who intends to apply for a permit to settle should submit:

    • four application forms (wniosek o udzielenie zezwolenia na osiedlenie się ) filled out in Polish
    • five passport size photographs ( 4.5 cm -3.5 cm )
    • a valid passport
    • documents certifying  required uninterrupted stay in Poland
    • certificate of no tax arrears towards the State Treasury
    • current certificate of temporary residence
    • legal title to an apartment  and documents certifying the cost of residence

    Attention:

    An agreement to lend an apartment shall not be considered a legal title to an apartment, unless  the lender is the non-Polish citizen's descendant, ascendant or spouse, spouse's parents or their parents.

    Additionally the following documents should be attached:

    In the case of a minor child of an alien who holds a permit to settle and was born on the territory of the Republic of Poland:

    • current birth certificate
    • copy of the decision to grant a permit to settle or of residence permit held by the child's legal representative

    In the case of a child of a Polish citizen under parental custody:

    • current birth certificate
    • copy of ID of the child's legal representative

    In the case of marriage with a Polish citizen:

    • current marriage certificate
    • copy of ID of spouse
    • if there were children born in the marriage: birth certificates

    All foreign language documents must be translated into Polish and confirmed by the Consul. All copies must be certified as consistent with the original.
